When regulation changes how retailers operate, affected businesses need a coordinated voice at the table. This is central to RETRAK’s role as a member-led association.
Following our submission on the Nairobi City County Finance Act, 2026, RETRAK alongside member representatives sought audience with the leadership of The Liquor Licensing Board to seek clarity on the new KSh 100,000 online alcoholic drinks licence. The board explained that the licence is intended as a deliberate entry threshold for the online liquor market. They further clarified that it may apply separately to individual online sales and order-fulfilment channels, retailer websites and other online platforms.
This interpretation could multiply compliance costs for omnichannel retailers. RETRAK therefore raised the need for clarity on the unit of licensing, territorial application and the respective obligations of retailers, marketplaces, fulfilment operators and delivery providers.
The Board is committed to updating the licence terms and conditions and agreed to a stakeholder engagement early next week. This consultation will allow affected businesses to present operational evidence and help shape a clearer, proportionate and workable compliance framework.
Is your business affected or potentially affected? Please register your interest in the stakeholder engagement by clicking on the link in the comment section below. We invite enterprises to join RETRAK and strengthen the collective retail-sector voice. Membership enables businesses to contribute directly to RETRAK’s policy positions, participate in consultations, receive timely regulatory updates and benefit from sustained representation before government and regulators.
Effective advocacy begins with businesses showing up, sharing evidence and speaking together.
