The Tax Laws (Amendment) Bill, 2026 proposes an important change to the excise-duty framework for imported ceramic tiles. The Bill confirms the 5% ad valorem rate, following the earlier 35% policy position, and replaces the weight-based charge of KSh 50 per kilogram with KSh 300 per square metre. If enacted, the applicable duty will be 5% of the excisable value or KSh 300 per square metre, whichever is higher.
This is a significant outcome of RETRAK’s sustained advocacy and the evidence provided by our members on how the previous framework affected pricing, competitiveness, stock movement and business continuity. Moving from weight to surface area also provides a more commercially relevant basis for assessing tiles.
Pursuant to the provisions of Standing Order 120, the National Assembly via Order paper of 8th October, 2026 resolved to reduce the publication period of specified bills, such as the Tax Laws (Amendment) Bill (National Assembly Bill No. 65 of 2026) from fourteen (14) days to ten (10) days, with the public participation period scheduled for October 13, 2026.
RETRAK invites affected members to share their assessment of the proposed formula, including its likely effect on landed costs, retail prices, inventory, employment and market competitiveness. We also welcome views on whether full removal or transitional relief is necessary to support businesses that suffered losses under the previous regime.
Your evidence will guide RETRAK’s next engagement with Government and Parliament. Please share your comments through
